TikTok spent months arguing that our bipartisan divestiture bill was a threat to free speech, but the DC Circuit Court concluded the exact opposite.

In today’s ruling, the Court stated, “The First Amendment exists to protect free speech in the United States. Here the Government acted solely to protect that freedom from a foreign adversary nation and to limit that adversary’s ability to gather data on people in the United States. For these reasons the petitions are denied.”

Two things are now clear: our bill is not a threat to free speech, but TikTok is a threat to the Free World. It’s time for ByteDance to allow for a divestiture by January 19 so Americans can use this app free from the threats posed by its ownership structure.
