Leaving the substantive outcome of the birthright citizenship case aside, its legal reasoning (in both the majority opinion and the dissent) is a perfect example of why any variation of legal internalism—be it textualism or historical originalism—is necessarily an imprecise exercise in ritualistic sociopolitical legitimation, in which the standards are made up and there is no such thing as objective correctness. That said, all the alternative modes of legal argument (explicitly political, explicitly value based, etc) are, functionally, much worse in at least this kind of political context.
